Vancouver604 Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Temper Tantrum Studios Inc [confirm legal entity name / business number] ("Vancouver604," "we," "us," or "our"), a company based in British Columbia, Canada, governing your use of the Vancouver604 mobile application, website and related services (the "App" or "Service").

By downloading, installing or using Vancouver604, you agree to these Terms. If you don't agree, please don't use the App.


1. What Vancouver604 is

Vancouver604 is a free, ad-supported service that provides real-time traffic reports, weather, local news and sports for the Metro Vancouver area, including a live "radio-style" broadcast generated from a mix of licensed data, editorial content and user-submitted incident reports. Features include a live map, hold-to-talk and SMS incident reporting, proximity alerts, CarPlay support and border and ferry wait times.

Vancouver604 is informational only. It is not a substitute for road signs, posted traffic regulations, law enforcement instructions or your own judgment. See Section 8 (Driving Safety).


2. Eligibility and accounts

You must be able to form a binding contract to use Vancouver604, and the App is not directed at children under 13 (see our Privacy Policy, Section 9).

You can use most of the App, listening to the broadcast, viewing the map and submitting reports, without creating an account. If you choose to sign in (with Apple, Google or a phone number), you're responsible for keeping your credentials secure and for all activity under your account.

Account deletion. You may permanently delete your account and associated personal information at any time from within the App, under Settings, then Delete My Account. See our Privacy Policy for what deletion does and does not remove.


3. User-submitted content (incident reports)

Vancouver604 lets you submit traffic incident reports by voice, text or SMS, and to confirm or deny reports submitted by other users ("User Content").

License you grant us. By submitting User Content, you grant Vancouver604 a worldwide, royalty-free, non-exclusive license to use, reproduce, adapt, publish, translate into other formats (including AI-generated broadcast audio) and distribute that content as part of the Service, including sharing derived incident information (with your identity removed or pseudonymized, per our Privacy Policy) publicly on the traffic map, the website and the broadcast.

Accuracy. Incident reports are submitted by other drivers and are not independently verified by us before being broadcast, though we use a confidence and confirmation system to weigh reliability. Do not rely solely on user-submitted reports for safety-critical decisions. Always exercise your own judgment and follow posted signage and law enforcement direction.

Content standards. You agree not to submit content that:

Moderation. There is zero tolerance for objectionable content or abusive users. We use automated filtering and human review to screen content, and we may remove content, suspend or terminate accounts that violate these standards, at our discretion and without prior notice. We review reported content within 24 hours. If you encounter objectionable content or another user, you can report it or block that user from within the App, or contact us at support@vancouver604.com.


4. Reputation scores

We calculate an internal reputation score for reporting accounts, based on the accuracy of your past reports, to help weigh how much confidence the system places in your reports. This score is used only within Vancouver604 and is not shared with advertisers or other users in identifiable form.


5. Advertising

Vancouver604 is supported by contextual audio and in-app advertising, targeted only by broadcast zone and time of day, never by information that identifies you personally. See our Privacy Policy for details. Advertisers are third parties, and we are not responsible for the content, products or services they offer; any transaction you have with an advertiser is solely between you and that advertiser.


6. Third-party services and data

Vancouver604 relies on third-party data sources and service providers, including government open-data feeds (such as DriveBC and CBSA border wait times), cloud hosting, speech-to-text, AI text processing, text-to-speech and SMS providers. We are not responsible for the accuracy, availability or content of third-party data sources, and your use of any third-party service accessed through the App may be subject to that provider's own terms.


7. Location and permissions

Some features require access to your device's microphone, location, notifications or speech recognition. You can grant or revoke these permissions at any time in iOS Settings. Declining a permission may limit certain features (for example, Proximity Alerts require background location), but you can still use the core broadcast, map and reporting features.


8. Driving safety

Please use Vancouver604 responsibly. The App is designed to be used hands-free while driving (for example, via CarPlay, voice reporting and audio broadcast), but you are solely responsible for operating your vehicle safely and in compliance with all applicable laws, including laws on distracted driving and mobile device use while driving. Never manually type, read or interact with the App's screen while your vehicle is in motion. Information provided by the App, including traffic conditions, incident locations and wait times, may be delayed, incomplete or inaccurate, and must never be treated as a substitute for road signs, posted regulations or law enforcement instruction.


9. Intellectual property

The App, including its design, branding, logos, wordmark, software and editorial content (but excluding User Content and third-party data), is owned by Vancouver604 or its licensors and is protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on your own devices for your personal, non-commercial use, subject to these Terms and, where applicable, the App Store's usage rules described in Section 16.


10. Disclaimer of warranties

The App and all content and data provided through it are provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy, to the maximum extent permitted by law.

We do not warrant that: the App will be uninterrupted, timely, secure or error-free; traffic, weather, news, sports or wait-time information will be accurate, complete or current; or any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.


11. Limitation of liability

To the maximum extent permitted by law, Vancouver604 and its officers, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising from or related to your use of (or inability to use) the App, including reliance on any traffic, weather, incident or wait-time information, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded under applicable law (including consumer protection law in British Columbia and Canada generally), our total liability to you for any claim arising from these Terms or your use of the App is limited to the greater of CAD $50 or the amount you paid us in the 12 months before the claim arose (which, for most users of this free App, will be $0).

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.


12. Indemnification

You agree to indemnify and hold Vancouver604 harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising from your violation of these Terms, your User Content or your misuse of the App.


13. Termination

You may stop using the App at any time and delete your account as described in Section 2. We may suspend or terminate your access to the App or any account, with or without notice, if we believe you've violated these Terms, misused the reporting system or created risk or legal exposure for us or other users. Sections that by their nature should survive termination (including Sections 9 to 13 and 16) will survive.


14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll notify you in the App before it takes effect. Continued use of the App after a change takes effect means you accept the updated Terms.


15. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You and Vancouver604 agree to submit to the exclusive jurisdiction of the courts located in British Columbia, Canada, for any dispute not otherwise resolved informally, except where applicable consumer protection law gives you the right to bring a claim in your local jurisdiction.

16. Apple App Store terms

Because Vancouver604 is distributed through Apple's App Store, the following additional terms apply and take precedence over any conflicting term above solely with respect to your use of the App on Apple devices, per Apple's licensed application end user license agreement requirements:

16.1 Acknowledgement. These Terms are between you and Vancouver604 only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content.

16.2 Scope of license. Vancouver604 grants you a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store's Usage Rules.

16.3 Maintenance and support. Vancouver604, not Apple, is solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.

16.4 Warranty. Vancouver604, not Apple, is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Vancouver604's sole responsibility.

16.5 Product claims. Vancouver604, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

16.6 Intellectual property. In the event of any third-party claim that the App or your possession and use of it infringes that party's intellectual property rights, Vancouver604, not Apple, is solely responsible for the investigation, defense, settlement and discharge of any such claim.

16.7 Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

16.8 Developer contact. Questions, complaints or claims regarding the App should be directed to: Vancouver604, support@vancouver604.com.

16.9 Third-party terms of agreement. You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.

16.10 Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.


17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our Privacy Policy, are the entire agreement between you and Vancouver604 regarding the App.
